MUSIC DESIGN GROUP – COMPETITION TERMS & CONDITIONS 1. The Promoter, The Promoter is: Music Design Group of International House, 61 Mosley Street, Manchester, England, M2 3HZ 2. The Competition 2.1. The title of the Competition is ”Win A Nord Electro 6”.2.2. To enter, entrants will need to share a streamable video of their piano or keyboard playing ability and fill out the form on our dedicated website. 3. How To Enter 3.1. The Competition will run from [16:00] on 03/11/2021 to [23:59] on 17/11/2021 inclusive. 3.2. All competition entries must be received by the Promoter by no later than [23:59] on the Closing Date. All competition entries received after the Closing Date are automatically disqualified. 3.3. Only where absolutely necessary, the Promoter reserves the right to change the Opening and Closing dates. If the Promoter does change these Dates for any competition, the new details will be displayed on www.ostereo.com/competition. 3.4. To enter the Competition, entrants must enter the Competition online by following the relevant link in the social media posts and completing and submitting the online entry form provided on www.ostereo.com/competition by the Closing Date. 3.5. No purchase is necessary to enter the Competition, and there is no charge to enter via the use of our dedicated website. 3.6. The Promoter will not accept:(a) responsibility for competition entries that are damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or (b) proof of transmission as proof of receipt of entry to the Competition. 3.7. By submitting a competition entry through completion of the online entry form provided on www.ostereo.com/competition, entrants are agreeing to be bound by these terms and conditions. 3.8. The Competition entries will be judged by a panel of three judges based on their creativity talent and potential to maximize benefit from the award of the Prize, which will include at least one independent judge. The decision of the panel of judges (acting reasonably) will be final. 3.10. A list of names of the judges can be viewed on www.musicdesigngroup.com from the Closing Date for a period of 30 days. 4. Eligibility 4.1. The Competition is only open to all residents in the UK aged 18 years or over in their personal capacity, except:(a) employees of the Promoter or its holding or subsidiary companies;(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the Competition or its administration; or(c) members of the immediate families or households of (a) and (b) above. 4.2. In entering the Competition, entrants confirm that they are eligible to do so and eligible to claim the prize. The Promoter may require entrants to provide proof that they are eligible to enter the Competition. 4.3. The Promoter will not accept competition entries that are: automatically generated by computer, or which infringe upon the intellectual property rights of any third party. 4.4. There is a limit of one entry to the Competition per person, band or act. 4.5. The Promoter reserves all rights to disqualify any entrant if their conduct is contrary to the spirit or intention of the prize competition. 5. The Prize 5.1. The Prize is described on the Website and competition listing on any of the Promoter’s pages (including, without limitation, any social media pages or channels owned or operated by the Promoter). Details of the Prize are, to the best of the Promoter’s knowledge, information and belief, correct as at the Opening Date. If any details of the Prize change, the Promoter will use reasonable endeavours to update the Website and/or and competition listing/s on its page/s as soon as reasonably practicable. 5.2. The Prize is subject to availability. There is no cash alternative for the prize. 5.3. The prize is supplied by Midwich Ltd. Registered Office: Vinces Road, Diss, England. IP22 4YT. The prize does not include travel costs, food and drink, tax or personal expenses, which are the responsibility of the winning entrant and any of its individual members, in addition to any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize. 5.4. The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control make it necessary to do so. The Promoter makes no representation and gives no warranties about the Prize, its value, its condition or any other information provided in social media posts, on www.musicdesigngroup.com or any other competition listing/s.5.5. The prize is not negotiable or transferable. 6. The Winning Entrant 6.1. The decision of the judge nominated by the Promoter is final and no correspondence or discussion will be entered into. 6.2. The Promoter will contact the winning entrant personally as soon as practicable after the Announcement Date, using the email address provided with the Competition entry. The Promoter will not amend any contact information once the Competition entry form has been submitted. 6.3. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the winning person, band or act’s full name (or the full names of each member of the band or act), social media handles and any pseudonyms and, if applicable, their winning entries via Facebook, Instagram, Youtube, Twitter and/or Tiktok on 24/11/2021 (Announcement Date). 6.4. If the winning entrant or any of its individual members object to any or all of their surnames, counties and winning entries being published or made available, they should contact the Promoter via the contact details listed on www.musicdesigngroup.com. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request. 7. Claiming The Prize 7.1. The prize may not be claimed by a third party on an entrant’s behalf. 7.2. The Promoter will make all reasonable efforts to contact the winning entrant, using the e-mail address provided on entering the competition, within 30 days of the Closing Date. If the winning entrant cannot be contacted or is not available within 30 days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date. 7.3. The Promoter does not accept any responsibility if the winning entrant is unable to take up the prize. 8. Limitation Of LiabilityInsofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winning entrant or its individual members or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. The statutory rights of any individual entrant are not affected. 9. Ownership Of Competition Entries And Intellectual Property Rights 9.1. The Promoter does not claim any rights of ownership in competition entries. 9.2. You agree that the Promoter may, but is not required to, make the winning entrant’s entry available on its website www.musicdesigngroup.com and any other media, whether now known or invented in the future, and in connection with any publicity of the Competition. The winning entrant and its individual members agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the Competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the Competition entry to any other entities upon whose behalf the competition is being promoted and any accompanying materials for such purposes. 10. Data Protection And Publicity 10.1. The Promoter will only process personal information relating to any entrant or its individual members as set out in the privacy policy – www.musicdesigngroup.com/privacy-policy. See also condition 6.3 and condition 6.4, with regard to the announcement of winners. 11. General 11.1. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude any entrant from participating in the Competition. 11.2. The Promoter reserves the right to hold void, suspend, cancel, or amend the Competition where it becomes necessary to do so. 11.3. These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
